Terms of Service for Rat Race Spray LLC

Please read these Terms of Service (“Terms”) carefully before purchasing or using Rat Race Rodent Repellent (“Product”) from Rat Race Spray LLC (“Company,” “We,” “Us,” or “Our”). These Terms govern your access to and use of our website at ratracespray.com (“Website”), your purchase of the Product, and your use of the Product. By accessing the Website, purchasing the Product, or using the Product, you agree to be bound by these Terms. If you do not agree, do not access the Website, purchase, or use the Product.

These Terms apply to all users, including homeowners purchasing for personal use. You represent that you are at least 18 years old and legally capable of entering into contracts. If you are purchasing on behalf of an entity, you represent that you are authorized to bind that entity.

1. Company Information

Rat Race Spray LLC is a California limited liability company located at 255 Watson St., Monterey, CA 93940. We manufacture and sell Rat Race Rodent Repellent, an essential oil-based spray designed for homeowners to apply in vehicle engine bays and wheel wells to help protect vehicle wires. The Product is compliant with FIFRA regulations under 40 CFR Part 156 and qualifies as a minimum-risk pesticide under FIFRA Section 25(b).  

2. Product Description and Use

The Product is intended solely for consumers to help protect vehicle wires from rodent damage. Apply as directed on the label: spray liberally in engine bays and wheel wells. Reapply every 30 days.

• Proper Use: Follow all instructions on the Product label. Use in well-ventilated areas. Avoid contact with eyes, skin, or ingestion. Keep out of reach of children and pets.

• Warnings: This Product is not guaranteed to repel all rodents or prevent all damage. Effectiveness may vary based on environmental factors. If you experience irritation, discontinue use and seek medical advice. For California residents: This Product may contain trace amounts of chemicals known to the State of California to cause cancer or reproductive harm under Proposition 65. Visit www.P65Warnings.ca.gov for more information.  

• Misuse: Do not use for any purpose other than as described. We are not liable for damage resulting from improper application, storage, or use.

3. Purchases and Payment

• Ordering: Purchases can be made via the Website or by contacting Us directly. All orders are subject to availability and acceptance by Us.

• Pricing and Taxes: Prices are listed on the Website and exclude shipping, handling, and applicable taxes (including California sales tax). We reserve the right to change prices without notice.

• Payment: We accept major credit cards and other methods as specified. Payment is due at the time of order. You authorize Us to charge your payment method for the total amount.

• Shipping: We do not ship. 

• Cancellations: Orders may be canceled, Contact Us immediately.

4. Refunds and Returns

We offer a 30-day money-back guarantee for unopened Products. To return, contact Us for a return authorization. You are responsible for return shipping costs unless the Product is defective. Refunds will be issued to the original payment method within 14 days of receipt. Opened or used Products are not eligible for refund except for defects. We do not accept returns for Products damaged due to misuse.  We accept and refuse returns or exchanges at our discretion.

5. Warranties and Disclaimers

The Product is warranted to conform to its description and be free from manufacturing defects for 90 days from purchase. If defective, We will replace it or refund the purchase price at Our discretion.

EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL MEET YOUR EXPECTATIONS OR BE EFFECTIVE IN ALL SITUATIONS. USE AT YOUR OWN RISK.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR VEHICLE DAMAGE) ARISING FROM YOUR USE OF THE WEBSITE OR PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.  

7. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including attorneys’ fees) arising from your misuse of the Product, violation of these Terms, or infringement of third-party rights.

8. Intellectual Property

All content on the Website, including text, images, logos, and trademarks (e.g., “Rat Race Rodent Repellent”), is owned by Us or our licensors and protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or use any content without Our written permission. Use of materials for education or sharing product are permitted 

9. Prohibited Activities

You may not:

• Use the Website or Product for illegal purposes.

• Reverse-engineer or tamper with the Product.

• Post false reviews or spam.

• Interfere with the Website’s operation.

We may terminate your access for violations.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Monterey County, California. You waive any objections to venue or jurisdiction.

11. Changes to Terms

We may update these Terms at any time. Changes will be posted on the Website with the new effective date. Continued use constitutes acceptance.
